Don’t Mess With Texas

Texans are not pleased about how four states conducted the November Presidential vote and the State Attorney General Ken Paxton decided to do something about it. He has filed a very detailed lawsuit with the Supreme Court of the United States (SCOTUS).  His suit alleges that four states, Pennsylvania, Georgia, Wisconsin and Michigan, violated their own state constitutions, and the Equal Protection Clause found in the 14th Amendment of the United States Constitution.

In the lawsuit submitted to the court, Paxton alleges that there was fraud in the counted votes, because the states did not live up to their own constitutions, when issuing guidelines for mail-in ballots not sanctioned by the state legislatures.

When interviewed Wednesday, AG Paxton stated, “These elections in other states was where state law was not followed. It affects my voters because these are national elections, and so if there are fraudulent things or things that affect an election and state law is not followed as is required by the Constitution it affects our state. It affects every state. We can't go back and fix it, but we can say, OK, let's transfer this to the legislature ... and let them to decide the outcome of the election. That would be a valid constitutional situation." 

Part of Paxton's complaint to the Supreme Court reads as follows. "Using the COVID-19 pandemic as a justification, government officials in the defendant states of Georgia, Michigan and Wisconsin, and the Commonwealth of Pennsylvania (collectively, 'Defendant State'), usurped their legislatures’ authority and unconstitutionally revised their state’s election statutes. They accomplished these statutory revisions through executive fiat or friendly lawsuits, thereby weakening ballot integrity."

This legal challenge would, if successful, invalidate the 62 Electoral College votes from those four battleground states and award Trump a second term, alleging unconstitutional changes to election rules before the vote.

One of the ways you change and weaken ballot integrity is called “bundling”. Mail-in ballots are ripe for this kind of fraud and for years it has been a common practice of precinct commanders on the Democratic side. They go out and canvass for mail-in ballots, house to house, at times helping voters fill them out, then taking them to the polling place. With the unprecedented volume of ballots mailed in the past election, and using the pandemic as their excuse, those four states did violate their state mandates. All the fraud centers on the cities of Atlanta, Philadelphia, Detroit and Milwaukee, well known Democratic strongholds.

Mail-in ballot deceit is not a real debatable issue. It’s a fact.  The mail-in ballot is the biggest avenue of fraud this country has ever seen and the Democratic Party desperately wants universal mail-in. The matter is so serious that 18 states signed onto the Texas petition and over 100 Republican lawmakers have joined the suit in an Amicus Brief (friend of the court).

Texas' challenge to SCOTUS is not an attempt by Republicans to beat Democrats. It's an attempt by voters to invalidate unlawful orders issued by partisan governors and other elected officials in violation of the U.S. Constitution.

Consumers of televised news hopefully have seen the videos of counting irregularities and pens designed to keep poll watchers distanced from the counting process. Recent polls indicate that 47% don’t believe the presidential vote was honest. That, by any stretch, reflects a large lack of trust in the Nation’s time-honored electoral process.

The matter is before the Court and a ruling is expected today whether or not the Justices will hear the case, as this their last day to conference before the holiday break.  The United States was founded as a nation of well thought out laws, that have been amended, refined and codified to ensure that the founding freedoms fought for will always be paramount. Hopefully, however the courts rules, it will be perceived as fair and wise.

If we lose the rule of law, it doesn’t matter who is elected President. Unscrupulous actors will have an unfettered path to manipulate the process for their own candidates and agendas.  

It's that important.
