Pearl Clutching
Watching the meltdown of the left over the leaked Supreme Court draft opinion regarding abortion, is rapidly becoming the theater of the absurd. Pearls aren’t being clutched over this issue; they are being crushed. The interpretation of the proposed majority opinion and its effect on freedom is staggeringly outrageous. The possible overturn of the 1973 Roe v. Wade on which the Supreme Court ruled that allows abortion in the United States has created a progressive liberal firestorm.
The leaked majority opinion will not end abortion in the United States. The progressive Democrats don’t want Americans to know this. Their political goal is to frighten citizens into believing that Justice Alito is the brother of Darth Vader, hell bent on taking their personal freedom. It’s simply not true. Repealing Roe v. Wade would merely return abortion policy to the states and democratic debate about the policy. That’s it.
It is truly pathetic that elected officials and abortion advocates haven’t got a clue about what is in the United States Constitution. First, there is not a sentence about, or a paragraph containing the word abortion in the document. The Tenth Amendment of the Constitution states that any policy not articulated in the Constitution should be handled by the states. The founders created that amendment in anticipation of unseen legal issues/problems so that they would be adjudicated by the individual states. It’s too bad that the country’s education system doesn’t have a mandatory class in understanding the Constitution. We’d have less dunces and more understanding of the judicial process.
So how did this moral and judicial crises happen? Evidently someone from inside the Supreme Court, most likely one of the clerks, stole a majority opinion draft from Justice Samuel Alito, a conservative judge, about a Mississippi abortion law the Supreme Court is hearing right now. The suspected thief is believed to work for one of the three liberal Justices on the court, as any proposed opinion is circulated to all the Justices for review. Somebody took it and gave it to a pal at Politico, an online leftist news agency. Naturally Politico published it.
Since this level of leak has never happened before, chaos broke out everywhere regardless of political bent even though a draft is not a ruling. The Supreme Court issued the following statement, "Justice's circulate draft opinions internally. It's a routine and essential part of the court's confidential, deliberative work. Although the document described in yesterday's reports is authentic, it does not represent a decision by the court or the final position of any member on the issues in the case." Demonstrators appeared at the Supreme Court building and in front of the six conservative Justices’ homes after their addresses were published by a left-wing web site.
Showing up at their homes constitutes a violation of US Code Title 18 Section 1507 which states, “Whoever, with the intent of interfering with, obstructing, or impeding the administration of justice, or with the intent of influencing any judge, juror, witness, or court officer, in the discharge of his duty, pickets or parades in or near a building housing a court of the United States, or in or near a building or residence occupied or used by such judge, juror, witness, or court officer…” Unfortunately, the United States Attorney General Merrick Garland, a feckless fool, has failed to instruct the FBI and the Department of Justice to enforce the statute. Furthermore, the President continues as a befuddled mess and has not condemned this leftist mob intimidation. But no doubt if they were at liberal Justice Sotomayor’s home, he’d be in front of a teleprompter in a New York minute.
So, abortion isn’t going to be banned if Roe v. Wade is overturned. Like it or not it will remain as a medical intervention procedure with limits in some states as to when the procedure can be performed. States like California, New York, Illinois, or New Jersey will remain without restrictions unless their legislatures change the law. Other states will have restrictions decided by citizens at the ballot box. It’s called democracy.
Pearl crushing, teeth gnashing and demonstrating at a conservative Justice’s home isn’t going to change the decision as the left would have you believe. As barbaric as some say abortion is, the current laws regarding the procedure in the United States are far more liberal than you will find in Europe. Look it up and settle down.
